Responses to the Ministry of Justice's consultation
on legal aid reform...
all of which.....
Fell on deaf ears!
There's very little evidence that government has taken a blind bit of notice of anything from the 5,000 responses it received in response to the Ministry of Justice's consultation paper on legal aid reform. The responses were by and large well drafted, submissions compiled by lawyers, eminent law firms, advice agencies and lobbying bodies. Each one represented a considerable amount of work with some running to over a hundred pages.
This represented a great deal of hard work by those who prepared responses, there were also responses by individuals; - all of whom expressed a disapproval of government's plans to all but demolish legal aid in the social welfare sector of the civil legal aid bill; criminal legal aid remains relatively untouched.
Ken Clarke, the minister for justice has spoken a great deal about his plans to shake up legal aid and cut back expenditure by £350 million by 2015. Generally speaking government cuts are targeted at reducing individual budgets by an average of 25%; which makes it hard to understand why advice agencies funded by legal aid are faced with cuts averaging 69% across England & Wales.
Some areas of legal aid such as Employment and legal advice on complicated welfare benefit enquiries are being cut back by 100% ; - all help being withdrawn by October 2012.
Areas of debt and housing advice face severe cut backs too as does family, where there is a new emphasis on compulsory mediation.
Given the profound effect these changes will have on advice agencies, it is beyond comprehension that the justice minister and his scrutiny committee have paid so little attention to all of the constrictive concerns expressed by so many. It's noteworthy that when all the intelligent debate went on in the afternoon of the second reading in the House of Commons over the passing of the bill; - the justice minister absented himself - he was nowhere to be seen! One has to to wonder, given the sheer volume of all the responses raised by these damaging reforms, if Ken Clarke is having a little trouble in staying awake when really he should be paying far more attention!
The respondents to the consultation who gave details included: individual members of the judiciary, members of the House of Commons and House of Lords, individual solicitors and barristers, academics, members of the public and the following organisations:
