Here is a case study from a legal aid funded employment law specialist at Bolton CAB. This case was funded by legal aid, but would not be funded under new plans to remove all funding for anything at all to do with employment problems. This is a real story of a real person assisted by legal aid funding earlier this year
Mr. E
Mr. E is a 21-year old man who was working as an Assistant Gardener for a landscaping firm.
He was involved in a minor road traffic accident en route to a job in Yorkshire. As a result of this, his employer subjected Mr. F to various forms of bullying & harassment, eventually forcing him to resign.
Mr. E was owed wages for his final week + accrued holiday pay, which his employer refused to pay.
Mr. E felt this was unfair as he was not responsible for the accident. As a recently-qualified trainee working on his first major job since leaving education, this incident could also seriously affect his future career prospects.
An employment specialist at Bolton CAB advised Mr. E in accordance with the Employment Rights Act 1996, assisting him drafting a letter requesting all monies owed. The adviser also provided assistance with all the subsequent negotiations and meetings the client had with employer.
As a result of this, client was given a cheque for everything owed, with employer offering a formal apology & agreeing to reinstate him, initially on a trial basis with a view to going full-time in due course (this did happen several weeks later). This avoided the need for a potentially costly Employment Tribunal claim & kept his promising career on track
